Agreement between User and dreamsweek.com

Welcome to the Dreamsweek Terms and Conditions (or “Agreement”). This Agreement describes the terms and conditions that govern your use of our services at dreamsweek.com/ (our "Site" or “Platform”). Before you may become a user member of our Website, you must be read, understand, agree with and accept all of the terms of services contained in this Agreement and Dreamsweek's policies, including its Privacy Policy and Official Rules. These Policies and Rules change at some time, and you agree that they form part of this Agreement. Our Privacy Policies may be connected here: Privacy. The Official Rules here: Rules. All time you use our services you confirm your agreement to be bound by and acknowledge any changes to the Agreement (including the Policies and Rules). You also undertake to familiarise yourself with and comply with the Policies relevant to your use of our Site and the services provided under this Agreement (as may be amended from time to time).

By accepting this conditions (including the Policies and Rules), you agree to be bound by it to our website.
We may amend the terms and conditions from time to time. Amended terms will be posted on our Site. Except as stated in this Agreement, in a Policy, or as otherwise notified to you, all modified terms will automatically be used immediately. Your uninterrupted use of the Service following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes. If you do not consent with such modifications (or any of our Policies), you must terminate your membership with Dreamsweek. If, after any such changes to this Agreement or any of our Policies you continue to be a member of our Site, you will be considered by us to have accepted the several terms as part of the Agreement.

In this Agreement where the context permits a reference to "you" includes anyone access on your behalf or with your express or implied consent. A reference to this Agreement enclose the Policies, Disclaimers, and Rules unless stated otherwise.
Upon becoming a Member through the Registration process, or a Supporter, you agree that Dreamsweek may, in our sole discretion, modify the terms of this Agreement by updating the adjusted terms to the Dreamsweek.com website.

Meaning of a few words on our website:

- Users (individuals who make use of the service - whether registered or unregistered)

- Dreamers (Members: All individuals who register an account for service)

- Dream's Sower, Supporter (User or Member: An individual who donates to a campaign)

- Dreapel - Dream's Project Elaboration

- DreamShare (It's a monthly campaign)

- Support (Donation made to monthly campaign)

- Top Member (members with 4th cycle organized)

- SeedBonus (bonus offered to reach amdreall)

- Amdreall (American Dream for All)

- Refmark (Marketing de Referência)

- 4th Cycle (Bonus system and commission)

- Nineten Club - (Club of companies from the Ten plan)

User Participation on the Site

All visitors to Dreamsweek.com, whether registered or not, are considered as “Users.” If you register with Dreamsweek you become a “Member” and gain access to specific features, including the ability to post specific information about you and on the Service and interact with other Members about your  Campaign.

There is no need to register to access some of Dreamsweek functionalities. However, to gain access to certain features of the Service, you will need to register with Dreamsweek and create a member account. Your registration gives you access to the services and functionality that we may determine and maintain from time to time and in our only discretion.

When creating your account, you must provide accurate and complete information. But if you do not want to be identified, you can set an avatar with a nickname. It is not mandatory to identify to the public until your project is selected for DreamShare, with only two variables in this question.

You are only responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Dreamsweek immediately of any breach of security or unauthorized use of your account. Although Dreamsweek will not be responsible for your losings caused by any not authorized use of your account, you shall be responsible for the losses of Dreamsweek or others due to such unauthorized use.

As a member, you can control your Member Profile and how other Members communicate with you. By providing Dreamsweek your email address, you consent to our using the email address to send you Service-related notices, containing any notes required by law, instead of communication by postal mail.

The user is prohibited from using Dreamsweek on a way that could violate, directly or indirectly, any intellectual property law or right. This includes laws and intellectual property rights in the USA as well as other countries.

If the user needs further information about the use or terms of the website, or wish to give suggestions about how to improve the service, we put at your disposal a feedback and support section on Dreamsweek.com. The user has to be in mind that by doing this, is granting Dreamsweek an authorization to use and incorporate the mentioned suggestions in our service, without any compensation in return.

Members are responsible for paying all fees and applicable taxes associated with the amounts you receive as a personal project's support.

Dreamsweek grants you authorization to use the Service as outlined in this Agreement, provided that: you will not copy, distribute, or disclose any part of the Service.

You will not change or modify the part of the Service other than as may be precisely necessary to use the Service for its intended goal, and you will otherwise comply with the terms of this Agreement.

You consent neither to collect any personally identifiable information, including account names, from the Service nor to use the information systems arranged by the Service for any commercial solicitation.

To be chosen to the "DreamShare" to get your project funded by our community and friends, the user, who becomes the new "Week's Dreamer", agree to pay 16.5% for the services provided by DreamsWeek.

As a Dreamsweek user, your donation page published will be publicly available on the internet when your project is selected for DreamShare, for all to see, including search engines like Google and Yahoo. There are no private or hidden Dreamsweek donation pages after any financing. Your activity will be public.

You are accountable for complying with all applicable laws in all of your actions related to your use of Dreamsweek’s services here provided, indifferent to the objective of the method.  Also, you must accept the terms of this Acceptable Use Policy and rules.

You agree that the owners of this web site exclusively reserve the right and may, at any time and without notice and any liability to you, modify or discontinue this web site and its services or delete the data you provide, whether temporarily or permanently. We shall have no responsibility or liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any data or information.

Privacy

Your use of dreamsweek.com is subject to Dreamsweek's Privacy Policy and Official Rules. Please review our Privacy Policy and Rules, which also governs the Site and informs users of our data collection practices and rights and obligations of the member.

Electronic Communications

Visiting dreamsweek.com or sending emails to Dreamsweek constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Dreamsweek is not responsible for third party access to your account that results from theft or misappropriation of your account. Dreamsweek and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

If your account is a membership only it can be deleted at any time, just send us an email making this request. But if your account is connected to our Refmark system, then it must be donated by you to Dreamweek. This means that your data will all be deleted, but your reference remains so that other members are not harmed when building Amdreall's.

Sower's Team
We are all Dream's Sowers within the community, but we have a special team that does the heavy lifting so that every DreamShare Campaign is a real success. These are the ones we call Sower's Team

Sowers are our partners. They are the necessary support that every campaign requires to be a success. There is no employment contract between this team and Dreamsweek, except those who are directly involved with us working in our office in Orlando.

Sowers are members of the community with some privileges. They become volunteers in the condition of a regional or local director who earns commissions and bonuses for supporting other members with projects in the DreamShare campaign.

Fees and Payments
Creating an account or supporting a campaign by donating money is free.
All fees are collected for Dreamsweek among others by Stripe and PayPal (PayPal charges a transaction fee, for more information visit www.paypal.com).
You are responsible for paying all fees and applicable taxes associated with your use of the site.

Registering as a Dreamsweek member is free and setting up a Project on Dreamsweek is paid.

Service Fee:

We reserve the right to increase or change membership fees from time to time.

DreamShare Campaign:
Supports for Dreamshare campaigns are offered voluntarily by members or users of the site. We accept a minimum of $ 5 as a donation for the campaigns; however, there is no maximum value defined for these supports.

PayPal Fees:
Fees vary depending on your PayPal account type and location. For example, for commercial transactions in the USA, the fee is 2.9% + 30c per transaction. For a full list of PayPal fees, visit this PayPal page.
The funds are transferred directly to the Member - Via Paypal, Bank account or check.

Important:
a- Residing in the USA or anywhere on the planet you assure that is an individual person and not some kind of organization.

b-The funds you raise through our site will be used exclusively for the fulfillment of a personal project described and approved by Dreamsweek.

c-You will comply with all local, state and federal laws relevant when you receive your funds.

Children Under Thirteen

Dreamsweek does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use dreamsweek.com only with permission of a parent or guardian.

Cancellation/Refund Policy

The Member can cancel your subscription in 15 days if your subscription is paid in installments or in 30 days if it is made in a single payment.

Links to Third Party Sites/Third Party Services

The dreamsweek.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of Dreamsweek and Dreamsweek is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. Dreamsweek is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by Dreamsweek of the site or any association with its operators.

Certain services made available via dreamsweek.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the dreamsweek.com domain, you hereby acknowledge and consent that Dreamsweek may share such information and data with any third party with whom Dreamsweek has a contractual relationship to provide the requested product, service or functionality on behalf of dreamsweek.com users and customers.

No Unlawful or Prohibited Use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use https://dreamsweek.com strictly in accordance with these terms of use. Dreamsweek content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of Dreamsweek and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of Dreamsweek or our licensors except as expressly authorized by these Terms.

The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

However, Dreamsweek reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. Dreamsweek reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

Dreamsweek reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in Dreamsweek's sole discretion.

Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. Dreamsweek does not control or endorse the content, messages or information found in any Communication Service and, therefore, Dreamsweek specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized Dreamsweek spokespersons, and their views do not necessarily reflect those of Dreamsweek.

By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

International Users

The Service is controlled, operated and administered by Dreamsweek from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the Dreamsweek Content accessed through https://dreamsweek.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Members Postings
You are fully responsible for your own statements and Materials that you post in our site, groups, projects, courses, doc idea, chat room, or any other user interactive area of our site and any consequences, whether or not foreseen, to any party who may rely upon these statements. You agree that you will not take any action attempting to hold us responsible for any such Materials or statements.

Dreamsweek does not make any representations or warranties as to the truth or accuracy of any statement made or materials posted on or through our site, groups, projects, courses, doc idea, chat room, or any other user interactive area of our site. You agree and acknowledge that you assume the risk of any actions you take in reliance upon the information that may be contained in our site, groups, projects, courses, doc idea,, chat room, or any other user interactive area of our site.

We do not endorse or lend any credence for any statements that are made by any participant in our groups, projects, courses, doc idea, chat room, or any other user interactive area of our site. Any opinions or views expressed by our site, groups, projects, courses, doc idea,, chat room, or any other user interactive area of our site participants are their own. We do not endorse or support or otherwise give any credence or reason for reliance on any such statements or opinions.

Indemnification

You agree to indemnify, defend and hold harmless Dreamsweek, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Dreamsweek reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Dreamsweek in asserting any available defenses.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Class Action Waiver

Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and Dreamsweek agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. DREAMSWEEK AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

DREAMSWEEK AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Dreamsweek does not endorse any such products or services and does not warrant that any such products or services are available, will meet the user's needs, are appropriate for any particular use, or are of any certain quality. Dreamsweek does not guarantee that any product or service descriptions, reviews, portrayals, specifications, or the like are accurate. Under no circumstances will Dreamsweek be responsible for any loss or damage resulting from any person's reliance on any such product or service descriptions, reviews, or specifications contained on the Services. All products and services made available through the Courses and Training are sold by independent sellers and not sold by Dreamsweek.

The results may not be typical or expected for everyone. You acknowledge that the Dreamsweek through the funding campaign will only serve as the party of your fundraising activity.
Your actions are voluntary and in the Dreamshare Campaign has no contractual, joint venture, or other relationship that gives rise to any duties, benefits, liabilities, or other responsibilities. You agree to indemnify and hold the Dreamsweek, including its respective employees, agents, and guests, harmless from and against any and all costs,
losses or expenses, including reasonable attorney fees, that it may incur by reason of any claim or suit arising out of property damage or false or deceptive advertising.

All the information on this website is published in good faith and for general information purposes only. dreamsweek.com does not make any warranties about the completeness, reliability and accuracy of this information. Any action you take upon the information you find on this website (dreamsweek.com), is strictly at your own risk. dreamsweek.com will not be liable for any losses and/or damages in connection with the use of our website.

Termination/Access Restriction

Dreamsweek reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Florida and you hereby consent to the exclusive jurisdiction and venue of courts in Florida in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Dreamsweek as a result of this agreement or use of the Site. Dreamsweek's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of Dreamsweek's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by Dreamsweek with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
